This website is operated by Goldgar Services Inc., a Florida corporation engaged in the provision of community management services, parking enforcement administration, permit issuance, property inspection services, resident portal administration, guest parking program administration, and related ancillary services to homeowner associations and residential communities throughout South Florida. Throughout these Terms of Service, the terms “Goldgar,” “Goldgar Services,” “we,” “us,” and “our” shall collectively refer to Goldgar Services Inc. and its successors, assigns, agents, employees, contractors, affiliates, subsidiaries, and authorized representatives, unless the context otherwise requires a more limited interpretation.
These Terms of Service (“Agreement”) govern your access to and use of goldgarusa.com and all associated resident-facing applications, including without limitation the resident accounts dashboard, the vehicle permit registration system, the guest parking management application, and the guest parking request portal (collectively, the “Service”). This Agreement constitutes a legally binding contract between you (“User,” “Resident,” “Customer,” or “you”) and Goldgar Services Inc. The Agreement is subject to modification at any time at Goldgar’s sole and absolute discretion, and your continued use of this website following the posting of any such modifications shall constitute your binding acceptance of such changes without reservation.
Section 1 — Acceptance of Terms; Binding Agreement; Consent to Electronic Services
By accessing, browsing, or using this website in any manner whatsoever—including without limitation registering an account, submitting personal or vehicle information, uploading identity or vehicle documentation, purchasing products or services, or participating in any program administered or facilitated through this website—you hereby unconditionally accept, without modification, all of the terms and conditions set forth in this Agreement, together with all additional terms, conditions, policies, and guidelines referenced herein and/or incorporated by hyperlink, all of which are expressly incorporated into this Agreement by reference and shall form an integral part thereof.
By creating an account or otherwise engaging with the Service, you expressly consent to the electronic delivery of all notices, agreements, disclosures, and communications from Goldgar, including communications transmitted to the email address you provide at the time of registration. You further acknowledge and agree that your use of this website constitutes your affirmative consent to the processing, transmission, and storage of your personal information—including but not limited to your name, mailing address, email address, telephone number, vehicle information, and government-issued identity documentation—as described in these Terms of Service and in the Privacy Policy incorporated herein by reference.
These Terms of Service apply to all users of this website, including without limitation users who are residents, tenants, homeowners, guests, visitors, browsers, and any other individuals or entities who access or interact with the Service in any capacity. Any new features, tools, products, or services that may be added to the current platform at any future time shall also be subject to these Terms of Service. You are responsible for periodically reviewing this page for any changes, and your continued use of the website after the posting of any changes constitutes binding acceptance of those changes.
Section 2 — Eligibility; Capacity to Contract
By agreeing to these Terms of Service, you represent and warrant that: (i) you are at least the age of majority in your state or province of residence and possess the full legal capacity to enter into a binding contract; or (ii) you are the age of majority and have obtained the lawful consent of any minor dependent on whose behalf you are utilizing this website or its services. No individual under the age of majority is authorized to use this website without appropriate parental or guardian consent. Goldgar reserves the right to terminate access and void any transaction entered into by any person who does not satisfy the eligibility requirements set forth herein.
You further represent and warrant that: (i) you will not use the Service for any unlawful or unauthorized purpose; (ii) you will not, in the course of your use of the Service, violate any applicable federal, state, provincial, or local statutes, regulations, rules, or ordinances; (iii) any information you submit through the Service—including personal, residential, and vehicular information—is truthful, current, and accurate to the best of your knowledge; and (iv) you are a lawful resident or authorized representative of the residential property address associated with your account. A breach or violation of any provision of these Terms will result in the immediate termination of your access to the Service without prior notice.
Section 3 — General Conditions of Use
Goldgar Services reserves the unconditional right to refuse Service to any person, at any time, for any reason, without obligation to disclose the basis for such refusal. You acknowledge and agree that your content (excluding credit card or payment information) may be transmitted in unencrypted form and may involve: (a) transmission over various third-party networks and infrastructure; and (b) modifications necessary to conform to the technical requirements of such connecting networks or devices. All payment card information and sensitive financial data shall at all times be encrypted in transit.
You expressly agree not to reproduce, duplicate, copy, sell, resell, reverse-engineer, or exploit any portion of the Service, any use of the Service, or any access to the Service or any information, materials, or content made available through the Service, without the prior express written permission of Goldgar Services. The section headings and titles used in this Agreement are included solely for organizational convenience and shall not limit, expand, or otherwise affect the scope or interpretation of these Terms of Service.
Section 4 — Accuracy, Completeness, and Currency of Information
Goldgar Services does not warrant or guarantee that the information made available on this website is accurate, complete, timely, or current at all times. All material published on this website is provided for general informational purposes only and shall not be relied upon as the sole basis for making any decisions of legal, financial, regulatory, or operational significance. Any reliance on the information contained on this website is undertaken entirely at your own risk, and Goldgar expressly disclaims any and all liability arising therefrom.
Certain information displayed through the Service—including without limitation community parking rules, vehicle permit records, permit eligibility status, guest parking usage calculations, and community address directories—may be served from internally maintained data caches and may not reflect the most recent administrative updates in real time. Goldgar assumes no liability arising from any decision made by a resident, guest, or third party in reliance upon information that was subsequently updated, revised, or superseded in Goldgar’s operational records after the time of display. You agree that it is your responsibility to monitor changes to this site and to confirm the current status of any records affecting your use of the Service.
Section 5 — Products and Services; Pricing and Availability
Certain products or services may be available exclusively through the online portal of this website and may be subject to quantity limitations. Such products or services shall be subject to return or exchange solely in accordance with the Refund Policy published at [Refund Policy]. All pricing for products and services listed on this website is subject to change at any time without prior notice, at the sole discretion of Goldgar Services. Goldgar reserves the right, but is not obligated, to limit the sale of any products or services to any person, geographic region, or jurisdiction on a case-by-case basis, and to discontinue any product or service at any time.
Goldgar does not warrant that the quality, performance, or characteristics of any products, services, information, or other materials purchased or obtained through the Service will meet your expectations, or that any errors in the Service will be corrected. Customers acknowledge and understand that they bear sole responsibility for purchasing the correct quantity of permits corresponding to the number of vehicles they intend to register, and that such registrations must comply with applicable community association bylaws. The purchase of a permit product through this website initiates the registration process but does not guarantee final approval. Goldgar shall bear no liability, nor shall any refund or reimbursement be issued, for registrations or permits purchased that are inconsistent with the resident’s community bylaws, applicable parking regulations, or the governing decisions of the applicable community association board.
Section 6 — Billing, Payment, and Account Information
Goldgar Services reserves the right, in its sole and absolute discretion, to refuse, limit, or cancel any order placed through this website. Such restrictions may include, without limitation, orders placed by or under the same customer account, the same payment method, and/or orders utilizing the same billing and/or mailing address. In the event that Goldgar modifies or cancels any order, Goldgar may endeavor to notify you using the contact information provided at the time the order was placed, though no obligation to provide such notice is hereby created or implied.
You agree to provide current, complete, accurate, and truthful purchasing and account information for all transactions completed through this website. You further agree to promptly update your account information—including your email address, payment information, and community or residential address—to ensure the accuracy and completeness of records necessary for Goldgar to fulfill its service obligations. You acknowledge that the provision of false, misleading, or materially inaccurate account information constitutes a material breach of this Agreement and may result in the immediate suspension of your account, voiding of any associated permits or program benefits, and such other remedies as Goldgar deems appropriate. Section 7 — Account Registration; Identity and Address Verification
In order to access the resident portal and associated services, you must complete the registration process, which requires the submission of accurate personal information including your full legal name, current mailing address, email address, telephone number, and resident status. You acknowledge and agree that the submission of a valid, government-issued photographic identification document—including but not limited to a driver’s license or state-issued identification card—is a mandatory condition of registration and is required to verify your identity and residential address. By submitting such documentation, you hereby consent to Goldgar’s collection, temporary retention, and administrative review of such identity documents for the purpose of verifying your eligibility and residential status.
You further acknowledge and agree that: (i) only one account may be registered per property address; (ii) the submission of a duplicate email address or a property address already associated with an existing account will result in the rejection of your registration; (iii) tenants seeking to register must provide a current lease agreement or other documentation evidencing their lawful occupancy of the subject property; and (iv) all submitted information is subject to verification against the applicable community association’s records, and any discrepancy identified between the information you submit and the records maintained by the community association or Goldgar may result in the denial, suspension, or revocation of your account or permit privileges.
Upon submission of your registration, your account will be placed in a pending verification status, during which time access to certain features and services may be limited. Goldgar and the applicable community association reserve the right, in their sole and absolute discretion, to approve, deny, or request additional information with respect to any registration application, for any reason and without obligation to disclose the basis for such determination. A denial of your registration application does not entitle you to a refund of any permit fee paid unless otherwise provided under the Refund Policy.
In the event that Goldgar, in its sole discretion, determines that a resident’s submitted address documentation does not conclusively establish residential address at the time of registration, Goldgar may, subject to applicable Florida statutory authority including Florida Statute § 322.19, grant a conditional extension period not to exceed sixty (60) days, during which the resident may obtain and provide conforming documentation. The grant of such an extension is at Goldgar’s sole discretion and does not constitute a waiver of any right to deny the application upon expiration of the extension period.
Section 8 — Document Collection, Storage, and Disposal
In connection with the registration and vehicle change-request processes, Goldgar collects and temporarily retains certain identity and vehicle documentation, including without limitation government-issued driver’s license images and vehicle registration documents (collectively, “Uploaded Documents”). By uploading any document through this website, you hereby grant Goldgar a limited, non-exclusive license to store, access, display to authorized administrative personnel, and process such Uploaded Documents solely for the purpose of evaluating and acting upon your pending application or request. You represent and warrant that all Uploaded Documents are authentic, unaltered, and accurately represent the information they purport to contain, and that you are legally authorized to submit such documents in connection with your registration.
Uploaded Documents are stored in a secure, access-controlled cloud storage environment and are accessible solely to authorized Goldgar administrative personnel. Driver’s license images associated with an address verification request shall be automatically and permanently deleted from Goldgar’s storage systems upon the rendering of any administrative decision with respect to the associated request, whether such decision is an approval, denial, or extension. Vehicle registration documents associated with a vehicle change request shall similarly be purged upon the administrative approval of the associated request. Goldgar makes no representation or warranty that Uploaded Documents will be retained for any minimum period of time, and you acknowledge that such documents may be purged at any time following the conclusion of the applicable review process.
Goldgar shall not be liable for any loss, damage, or claim arising from: (i) a failure or interruption of the document upload process caused by network conditions, browser compatibility, or any other technical factor beyond Goldgar’s reasonable control; (ii) the inability to retrieve or restore Uploaded Documents following their scheduled or unscheduled purge from storage; or (iii) any unauthorized access to or disclosure of Uploaded Documents resulting from a breach of a third-party cloud storage provider’s security infrastructure. In the event of an upload failure, Goldgar reserves the right to request re-submission of the applicable documentation and to place the associated application in a pending status pending such re-submission.
Section 9 — Vehicle Registration; Permit Administration; Enforcement
Residents with an approved and active account may register vehicles through the resident portal by submitting accurate vehicle information including the vehicle’s make, model, color, license plate number, and registration expiration date. You represent and warrant that all vehicle information submitted through the Service is accurate, complete, and corresponds to vehicles for which you hold lawful ownership, registration, or authorization to operate at the subject community property. The number of vehicles you may register is determined by the quantity of vehicle permit slots associated with your account, as established by your applicable permit purchase and community parking bylaws. Goldgar reserves the right to reject any vehicle registration submission that, in its judgment, exceeds applicable slot limits, contains materially inaccurate information, or is otherwise inconsistent with the applicable community parking program.
All vehicle registration requests, change requests (including without limitation vehicle replacements, license plate updates, and lost permit replacement requests), and blacklist appeals are subject to administrative review and approval. Goldgar and the applicable community association reserve the right to approve or deny any such request, in their sole discretion, for any reason. The submission of a vehicle change request does not guarantee approval, and any physical permit associated with the request shall not be issued or reissued until administrative approval has been granted. Upon administrative approval of a vehicle registration, the resident’s vehicle will be enrolled in Goldgar’s records and, where applicable, reflected in the applicable community’s parking enforcement database. Residents acknowledge and agree that enforcement personnel, including contracted parking enforcement officers and community inspectors, may access Goldgar’s records to verify vehicle registration status in real time.
Residents may remove a registered vehicle from their account through the self-service vehicle removal function available in the resident portal. Upon removal, the applicable vehicle permit slot associated with that vehicle will be decremented from the resident’s account, and the physical permit, if any, associated with the removed vehicle is immediately void and must be surrendered or destroyed. Goldgar assumes no liability for any enforcement action taken against a vehicle following its removal from the resident’s account, regardless of whether the resident retains physical possession of any associated permit decal. A vehicle that has been removed from a resident’s account may not be treated as registered for purposes of any enforcement or dispute.
In the event that a vehicle is flagged, blacklisted, or otherwise identified as non-compliant in Goldgar’s records, enforcement actions including the issuance of parking violations, vehicle immobilization, or towing may be initiated without prior notice to the resident. The resident may submit a blacklist appeal through the resident portal, which shall be subject to administrative review pursuant to the procedures described herein. The submission of a blacklist appeal does not automatically stay any ongoing or future enforcement action pending the outcome of such appeal, and Goldgar assumes no liability for any enforcement action taken against a vehicle during the pendency of an appeal.
Section 10 — Guest Parking Program; Resident Responsibility; Community Restrictions
Access to the guest parking management application is restricted to residents who have purchased an active guest parking plan associated with their account, as evidenced by the applicable plan tag applied to their account by Goldgar following a qualifying purchase. The guest parking program is subject to all applicable rules, restrictions, and period limitations established by each respective community association, including without limitation maximum stay durations per visit, cumulative usage limits per monthly, annual, or rolling period, and restrictions on the types of vehicles that may be registered as guest vehicles. Such community-specific rules are subject to change at any time by the applicable community association, and Goldgar assumes no liability for any guest parking activity that occurs in excess of applicable limits due to the resident’s reliance on outdated or cached usage information.
Each resident enrolled in the guest parking program is issued a unique, confidential guest access code by Goldgar administration. This guest code is used by guests to submit parking requests through the public guest parking request portal. The resident is solely and exclusively responsible for the security and confidential treatment of their guest code. Any guest parking request submitted using the resident’s guest code shall be attributed to the resident for purposes of usage tracking, period-limit enforcement, and all other program purposes, regardless of whether the request was submitted by the resident or by a third party to whom the resident disclosed the code. Goldgar assumes no liability for unauthorized or fraudulent guest parking submissions made using a resident’s guest code, and any usage incurred as a result of such submissions shall count against the resident’s applicable period limits without exception.
Pending guest parking requests submitted by a guest through the public portal are subject to the resident’s express approval before being registered in Goldgar’s active guest parking records. Until such approval is granted by the resident, no guest vehicle shall be deemed registered or protected from enforcement action. The resident is solely responsible for timely reviewing and acting upon pending guest requests, and Goldgar assumes no liability for any enforcement action taken against a guest vehicle that was not approved by the resident prior to its arrival at the community property. Upon resident approval of a guest request, the guest vehicle’s information is recorded in Goldgar’s guest parking records and made accessible to authorized community inspectors and enforcement personnel for the purpose of verifying the guest vehicle’s parking authorization during the approved stay period.
The resident hereby acknowledges and agrees that: (i) all guest vehicles registered through the guest parking program remain subject to community parking rules and enforcement protocols; (ii) Goldgar and the applicable community association reserve the right to deny, revoke, or limit guest parking privileges at any time for any reason, including without limitation repeated violations, abuse of the guest parking program, or non-compliance with community rules; (iii) guest parking privileges are non-transferable and are tied exclusively to the resident’s account and the specific community property associated with that account; and (iv) the guest parking program does not constitute a guarantee of available parking space, and Goldgar assumes no responsibility for any inability of a registered guest to obtain physical parking at the community property during an approved stay period.
Section 11 — Third-Party Tools, Platform Dependencies, and External Links
The Service is built upon and depends upon third-party cloud infrastructure and software platforms, including without limitation Shopify Inc. for e-commerce and customer account management, Microsoft Azure for secure document and data storage, Microsoft SharePoint Online for community records management, and Vercel Inc. for application hosting and delivery. Goldgar has no control over the operational continuity, uptime, performance, or security practices of these third-party platform providers. Any interruption, degradation, breach, or failure attributable to a third-party provider shall not constitute a failure of Goldgar’s obligations hereunder, and Goldgar assumes no liability for any loss, damage, or inconvenience arising from any such third-party platform event.
Third-party hyperlinks appearing on this website may direct you to external websites not affiliated with, operated by, or controlled by Goldgar. Goldgar neither examines nor warrants the accuracy, completeness, or legality of content available on third-party websites and assumes no liability or responsibility for any third-party materials, websites, products, or services. Any access to or use of optional third-party tools offered through the site is entirely at your own risk and discretion. Goldgar is not responsible for and shall have no liability whatsoever arising from or related to your use of optional third-party tools made accessible through or in connection with the Service.
Section 12 — Intellectual Property; Prohibited Uses
All content, materials, trademarks, logos, service marks, trade names, and proprietary information appearing on this website are owned by or licensed to Goldgar Services Inc. and are protected by applicable intellectual property laws. No license, assignment, or other transfer of intellectual property rights is granted to you by virtue of your access to or use of this website, except as expressly set forth herein.
In addition to all other prohibitions set forth in this Agreement, you are expressly prohibited from using this website or its content: (a) for any unlawful purpose or in furtherance of any unlawful act; (b) to solicit, encourage, or facilitate any unlawful conduct by others; (c) to violate any international, federal, state, or local statute, regulation, rule, or ordinance; (d) to infringe, misappropriate, or otherwise violate any intellectual property rights of Goldgar or any third party; (e) to engage in any conduct that is harassing, abusive, threatening, discriminatory, defamatory, or obscene; (f) to upload, transmit, or distribute any malware, viruses, spyware, or other malicious code; (g) to collect or harvest personal information about other users without their consent; (h) to engage in any form of unauthorized data scraping, crawling, or automated retrieval; (i) to submit false, misleading, or fraudulent information, including without limitation false identity documents, misrepresented vehicle information, or fabricated residential addresses; (j) to share, transfer, or disclose your account credentials, guest parking code, or any other access mechanism to any unauthorized party; or (k) to circumvent, defeat, or otherwise interfere with any security measures, access controls, or rate-limiting mechanisms implemented by Goldgar. Goldgar reserves the right to immediately terminate your access to the Service upon detection of any such violation.
Section 13 — User Submissions; Personal Information; Data Access and Consent
By using this website and creating an account, you affirmatively grant Goldgar Services and its authorized personnel, agents, and community association partners the right to access, review, store, process, and act upon all information you provide through the Service, including without limitation your personal identification information, residential address, vehicle registration details, government-issued identity documents, guest parking records, and any other data submitted in connection with your use of the Service. You acknowledge and agree that such information may be shared with the applicable community association, its board of directors, and contracted enforcement personnel to the extent necessary to administer the parking permit program, enforce community parking rules, verify guest parking registrations, and conduct parking inspections.
In the event that you submit, transmit, upload, or otherwise provide to Goldgar any information, documents, photographs, suggestions, ideas, feedback, proposals, or other materials (collectively, “Submissions”), you hereby grant to Goldgar a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, and otherwise exploit such Submissions for any lawful administrative or operational purpose, without obligation of confidentiality, compensation, or attribution. You represent and warrant that your Submissions are truthful, accurate, and do not infringe any third-party intellectual property rights, privacy rights, or other proprietary rights.
The collection, use, storage, and disclosure of personal information submitted through this website is governed by the Goldgar Services Privacy Policy, which is incorporated herein by reference and may be reviewed at [Privacy Policy]. By using this website, you expressly consent to the collection, use, and processing of your personal information as described therein and as supplemented by these Terms of Service.
Section 14 — Automated Systems; Session Security; Service Reliability
Access to the resident portal and associated services requires authentication through a time-limited session generated upon your account login. You are solely responsible for maintaining the security and confidentiality of your account credentials, session tokens, and any other authentication mechanisms associated with your account. Goldgar assumes no liability for any unauthorized access to your account or any action taken through your account in connection with any failure on your part to safeguard your login credentials. You agree to notify Goldgar promptly at Info@goldgarusa.com if you become aware of any unauthorized use of your account or any other breach of account security.
The Service employs automated rate-limiting mechanisms designed to prevent abuse of certain features, including without limitation the guest parking request submission portal, guest code verification functions, and account authentication endpoints. You acknowledge and agree that these rate-limiting measures may temporarily restrict your access to certain functions in the event that your usage volume exceeds applicable thresholds, and that Goldgar assumes no liability for any inconvenience or loss resulting from such temporary access restrictions. You further agree not to attempt to circumvent any rate-limiting, bot-detection, or access-control measure implemented by Goldgar.
Certain data and records displayed through the Service—including community parking rules, guest parking usage totals, and order histories—may be served from internally maintained caches that are refreshed periodically rather than in real time. Goldgar does not guarantee that such cached data reflects the most current state of the applicable records at the time of display. You acknowledge and agree that Goldgar assumes no liability for any enforcement action, permit denial, usage overage, or other consequence arising from any discrepancy between cached data displayed through the Service and the underlying records maintained in Goldgar’s administrative systems. Any dispute regarding the accuracy of records displayed through the Service must be submitted in writing to Goldgar via the contact information set forth in Section 22.
Section 15 — Disclaimer of Warranties; As-Is Service Provision
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall Goldgar Services, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. By participating in any program administered by Goldgar Services, purchasing products through this website, registering vehicles, or residing in a community that has contracted with Goldgar Services for enforcement or related services, you hereby expressly acknowledge and agree to the following terms and conditions. You grant Goldgar Services, its agents, employees, and authorized representatives the irrevocable right and permission to physically interact with your vehicle, including but not limited to touching, accessing, and applying decals, stickers, or other identifying markers, to include the permission to enter private property for this expressed purpose, as required by the terms of the program, the community's HOA rules, or as a result of purchases made through this website. You further understand and agree that failure to comply with your community's parking regulations, whether due to products obtained through this site or as part of Goldgar's enforcement services, may result in the placement of violation notices on your vehicle, towing, immobilization, or other enforcement actions, all of which shall be conducted at your sole expense. You agree that Goldgar, its representatives, and the HOA are not responsible or liable for any damage, loss, or injury related to the use of the Services, including any contact with or access to your personal property such as vehicles. This includes but is not limited to scratches, dents, towing-related damages, or other losses. You also agree that Goldgar and its representatives are not liable for any claims of trespassing on private property while performing Services. You accept full responsibility for any consequences resulting from your failure to comply with these Terms and waive any right to hold Goldgar, its representatives, or the HOA accountable for such issues. The Services are provided "as-is," and Goldgar makes no exceptions or warranties, express or implied, regarding their use and implementation. By using the Services, you release Goldgar and its affiliates from all claims, damages, or liabilities arising from these actions.
Section 16 — Permit Issuance, Distribution, and Permissions Release
Goldgar Services issues parking permits either by distributing them during vehicle inspections or shipping them directly to residents' addresses, depending on the program established with the community association or at our discretion.Â
By purchasing a permit, residents complete the registration process; however, final approval is subject to review by the community association's board. Both the association and Goldgar Services reserve the right to deny any parking permit application for any reason, and any refunds (if applicable) are granted solely at the discretion of the board and Goldgar.Â
Once registration is completed and approved by the board, Goldgar retains the right to issue permits at its convenience and is under no obligation to adhere to a strict timeline. However, vehicles with approved registrations will be safe-listed in our system immediately, protecting them from violations related to permit issuance delays—even if a physical permit has not yet been provided.Â
While Goldgar strives to process and issue permits in a timely manner, the company reserves the right to manage distribution as it deems appropriate.
Residents will only pay for parking permits and guest hangers issued to them in accordance to their communities parking bylaws and parking program.
No returns or refunds are permitted solely due to processing delays. For more information refer to the [Refund Policy]
Section 17 — Indemnification
You agree to indemnify, defend and hold harmless Goldgar Services and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Section 18 — Waiver of Liability and Legal Release
In consideration for the services provided by Goldgar Services, you hereby fully and irrevocably release, discharge, and hold harmless Goldgar Services, its affiliates, employees, contractors, and the community/HOA from any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to the application of decals, enforcement actions, towing, or any other interaction with your vehicle as described in these Terms of Service. This release applies to all known and unknown claims, whether arising from negligence, breach of contract, or any other legal theory, and extends to any third-party claims that may arise due to your communities participation in a parking enforcement contract with Goldgar Services or your use of Goldgar's services or website. You expressly waive any right to initiate legal action, file lawsuits, or pursue arbitration against Goldgar Services or the community/HOA for matters related to these services, including but not limited to property damage, towing disputes, or alleged violations of rights. You further agree to indemnify and defend Goldgar Services and the community/HOA against any claims brought by third parties (including other drivers, passengers, or vehicle owners) that result from any actions taken in accordance with your communities parking regulations, your use of products or services provided through this website, or any errors resulting form either. This waiver and release shall be binding upon you, your heirs, assigns, and legal representatives, and shall survive the termination of your relationship with Goldgar Services. You agree that Goldgar Services and the community/HOA shall not be held liable or accountable in any way for any damages, losses, or consequences arising from enforcement actions, towing, or any interactions with your vehicle, including those resulting from non-compliance with applicable rules or any errors in the process. Goldgar Services reserves the sole and absolute right to take or correct any such actions as it deems fit in its discretion. No legal action, lawsuit, claim, or proceeding of any kind may be initiated or maintained against Goldgar Services or the community/HOA in relation to any such matters. In the event of an incorrect violation or mistaken tow, Goldgar Services’ sole and exclusive liability shall be limited to forgiving the violation and/or reimbursing only the towing fee actually paid; under no circumstances shall Goldgar Services be responsible for storage fees or any other costs or damages any towing agency renders or charges. This provision shall apply regardless of the basis for the action and shall survive termination of these Terms. Goldgar Services reserves the sole and absolute right to modify, amend, or update its enforcement protocols, standard operating procedures (SOPs), or program requirements at any time and in its sole discretion without prior notice. By participating in this program or residing in a community serviced by Goldgar, you expressly agree to abide by all current and future protocols, policies, or changes implemented by Goldgar Services, and your continued use of this website or participation in the program constitutes acceptance of such modifications.
Section 19 — Errors, Inaccuracies, and Omissions; Severability
From time to time, information appearing on this website or disseminated through the Service may contain typographical errors, inaccuracies, or omissions relating to product or service descriptions, pricing, promotions, offers, availability, processing timelines, vehicle or permit records, or other characteristics. Goldgar expressly reserves the right, without prior notice, to correct any errors, inaccuracies, or omissions, and to change or update information at any time, including after a transaction has been submitted or an order has been placed. Goldgar undertakes no obligation to update, amend, or clarify information appearing on this website or through the Service except as required by applicable law.
In the event that any provision of these Terms of Service is determined by a court or arbitral tribunal of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nonetheless be enforced to the maximum extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service without affecting the validity, enforceability, or continued operation of any other remaining provisions. The parties acknowledge that the severance of any provision herein shall not affect the intent of the parties with respect to the remaining provisions of this Agreement.
Section 20 — Termination; Entire Agreement; Governing Law
All obligations and liabilities of the parties that accrued prior to the effective date of termination shall survive the termination of this Agreement for all applicable purposes. Goldgar reserves the right to terminate this Agreement and suspend or permanently revoke your access to the Service at any time, in its sole discretion, without prior notice, including in the event of any actual or suspected violation of these Terms of Service, any fraudulent or abusive conduct, or any misuse of the guest parking program or vehicle registration system. Upon termination, you shall remain liable for all amounts owed and obligations incurred through and including the date of termination.
These Terms of Service, together with all policies and operational rules posted by Goldgar on this website or incorporated herein by reference, constitute the entire agreement and complete understanding between you and Goldgar with respect to your use of the Service, and supersede and replace all prior and contemporaneous agreements, representations, communications, and proposals, whether oral or written. Any ambiguity in the interpretation of this Agreement shall not be construed against the drafting party. The failure of Goldgar to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
These Terms of Service shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, United States of America, without regard to any choice-of-law or conflict-of-law rules that would result in the application of the laws of any other jurisdiction. You hereby irrevocably consent to the exclusive personal jurisdiction of the state and federal courts situated in Broward County, Florida, for the resolution of any dispute arising out of or relating to these Terms of Service or your use of the Service.

Goldgar Services reserves the right, in its sole and absolute discretion, to update, amend, change, or replace any part of these Terms of Service at any time by posting the revised Agreement to this website without prior notice. You are solely responsible for periodically monitoring this page for any changes. Your continued use of or access to this website or the Service following the posting of any such changes shall constitute your binding acceptance of the revised Terms of Service without further notice or action required on the part of Goldgar.
This Agreement is entered into between you and Goldgar Services as independent contracting parties. Nothing in this Agreement shall be construed to create any partnership, joint venture, agency, employment, or fiduciary relationship between the parties. You may not assign or transfer this Agreement or any of your rights hereunder without the prior written consent of Goldgar; any purported assignment in violation of this provision shall be null and void. Goldgar may freely assign this Agreement without restriction. The provisions of this Agreement that by their nature are intended to survive expiration or termination shall so survive, including without limitation all provisions relating to limitation of liability, indemnification, waiver and release, document disposal, and governing law.
